OOF Skate Terms of Service

Effective Date: July 31, 2025

Welcome to OOF Skate, the mobile performance-analytics platform operated by OOF Inc. ("OOF," "we," or "us"). These Terms of Service ("Terms") govern your use of the OOF Skate mobile application and related services (together, the "Service"). By downloading, registering for, or using the Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Service.

1. Eligibility

Age Requirement: You must be at least 13 years old to use the Service. Anyone under 13 is strictly prohibited from registering or accessing the Service.
Minors (13–17 years): Users between ages 13 and 17 may use the Service only with parental or legal-guardian consent and supervision. By using the Service, you represent that you meet these requirements.

2. Account Registration & Security

Account Information: To register, you must provide your first and last name, email address, and phone number.
Accuracy & Updates: You agree to keep your account information accurate and current.
Credentials: You are responsible for safeguarding your password. You agree to notify us immediately of any unauthorized use of your account.
Termination for Breach: We may suspend or terminate your account if you violate these Terms or provide false information.

3. User Conduct & Acceptable Use

You agree not to use the Service to:

Upload or share illegal, offensive, infringing, or harassing content;
Threaten, bully, or discriminate against any person or group;
Introduce viruses, malware, or other harmful code;
Reverse-engineer, scrape, or interfere with the security or performance of the Service;
Spam, impersonate others, or engage in fraudulent conduct.

We may remove content or suspend accounts at our discretion for violations.

4. User Content & Licensing

Your Content: You retain ownership of videos and other materials you upload ("User Content").
License to OOF: By uploading, you grant OOF a worldwide, royalty-free, sublicensable license to use, process, and store your User Content and any derived anonymized skeletal or performance data only to operate, maintain, and improve the Service.
Sharing with Coaches: Any sharing of your content or data with coaches is initiated by you and requires your explicit action.

5. Data Collection, Anonymization & Retention

What We Collect: We collect video uploads, derived skeletal-tracking data, and performance metrics to provide analytics and feedback.
Anonymization: All data is anonymized (stripped of personal identifiers) before long-term storage.
Retention: We store anonymized data indefinitely to improve our models. Personal identifiers and raw content persist until you request deletion.
Deletion Requests: You may request deletion of your personal data or account via our website. We will erase or anonymize your data from active databases promptly; anonymized datasets that no longer identify you may remain for analytical purposes.

6. Privacy & Third-Party Services

No Sale of Personal Data: We do not sell or rent your personal information.
Cloud Hosting: We may use reputable cloud service providers to host and process data. These providers are bound by confidentiality obligations and may only process data on our behalf.
Privacy Policy Integration: Our Privacy Policy explains in detail how we collect, use, and protect your data and is incorporated by reference into these Terms.

7. No Paid Features (Yet)

Free Service Today: The Service is currently free of charge.
Future Fees: We reserve the right to introduce paid tiers or features. We will provide advance notice and require your express acceptance before charging any fees.

8. Disclaimers & No Warranties

Informational Use Only: All metrics and feedback are for informational purposes and not a substitute for professional medical, coaching, or safety advice.
No Guarantee of Accuracy or Results: We do not guarantee the accuracy of the analytics or that use of the Service will yield performance improvements.
"As-Is" Service: The Service is provided "as is" and "as available," without any warranties—express or implied, including merchantability or fitness for a particular purpose.

9. Limitation of Liability

To the fullest extent permitted by law, OOF Inc. and its affiliates will not be liable for any indirect, incidental, special, or consequential damages, including injury, loss of data, or lost profits, arising from your use of (or inability to use) the Service.

10. Indemnification

You agree to indemnify and hold harmless OOF Inc. and its officers, directors, employees, and agents from any claims, liabilities, damages, or expenses arising out of your breach of these Terms or your use of the Service.

11. Changes to the Service & Terms

We may modify or discontinue the Service (or any features) and these Terms at any time. Material changes to the Terms will be posted with a new effective date. Your continued use after changes constitute acceptance of the updated Terms. If you do not agree, you must stop using the Service.

12. Termination

By You: You may delete your account at any time via the app or by contacting us.
By OOF: We may suspend or terminate your access for violation of these Terms or for any reason, with or without notice. Surviving provisions (e.g., liability limitations, governing law) will remain in effect after termination.

13. Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of Delaware, USA. Any disputes will be resolved exclusively in the state or federal courts located in Delaware, and you consent to jurisdiction there.

14. Miscellaneous

Entire Agreement: These Terms (and the Privacy Policy) constitute the entire agreement between you and OOF Inc. regarding the Service.
Severability: If any part of these Terms is held invalid, the remainder will continue in full force.
Waiver: Failure to enforce any provision is not a waiver of future enforcement.
Assignment: You may not assign these Terms without our consent. We may assign our rights freely.
